General Terms and Conditions (T&C)

§ 1 Scope

(1) These General Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between CCX Consulting, David Lesnik (hereinafter "Provider") and the customer (hereinafter "Customer") via the website meilen-koenig.de.

(2) Deviating, conflicting or supplementary terms and conditions of the Customer shall only become part of the contract if and to the extent that the Provider has expressly agreed to their validity.

§ 2 Conclusion of contract

(1) The presentation of the products on the website does not constitute a legally binding offer, but a non-binding online catalog.

(2) By clicking the respective order button (e.g. "Buy now", "Subscribe with payment obligation"), the Customer makes a binding offer to purchase the selected product or to conclude the selected subscription.

(3) The contract is concluded when the Provider accepts the offer by means of an order confirmation by email or makes the digital product available for download or the service available for use.

§ 3 Prices and payment terms

(1) All stated prices are final prices and include statutory value added tax.

(2) Payment is made via the payment service provider Stripe. The Customer can pay by credit card.

(3) For one-time purchases, the purchase price is due immediately upon conclusion of the contract. For subscriptions (AI Premium subscription), the monthly amount is due at the beginning of each billing period and is automatically collected via Stripe.

(4) For payment processing, your billing address is collected and transmitted to Stripe. The Stripe consumer terms of service apply.

§ 4 Delivery of digital content

(1) For digital products (PDF files, MP3 AudioBooks), delivery is made by providing a download link by email immediately after successful payment.

(2) The Customer is responsible for backing up the downloaded content.

(3) For security reasons, download links are valid for 72 hours.

(4) In the event of technical problems or expired download links, please contact info@meilen-koenig.de for a new download link.

§ 5 Coaching services

(1) Coaching appointments are conducted as a video call (Microsoft Teams). After booking, the Customer receives proposed appointments from the Provider by email.

(2) The price of the coaching includes the Premium Handbook (PDF) and the AudioBook (MP3) as digital products. These are made available for download by email immediately after booking.

(3) The Customer can reschedule the coaching appointment free of charge up to 24 hours before the agreed appointment. Appointment changes must be communicated by email to info@meilen-koenig.de.

§ 6 MEILENKÖNIG AI (subscription and one-time access)

(1) The MEILENKÖNIG AI is an AI-based advisory service that can be used as a monthly subscription (AI Premium subscription), as an annual subscription or as part of the Premium Bundle (30 days access).

(2) AI Premium subscription: The subscription has a term of one month and renews automatically for a further month each time, unless it is canceled before the end of the respective billing period. Cancellation is possible at any time as of the end of the current billing period and is done via the Stripe customer portal or by email to info@meilen-koenig.de. After cancellation, access remains active until the end of the paid period.

(3) Premium Bundle: The AI access included in the Premium Bundle is a one-time purchase with a term of 30 days from the date of purchase. No cancellation is required; access ends automatically without the user having to do anything.

(4) Use of the MEILENKÖNIG AI is subject to the Fair Use Policy. In the event of violations of the Fair Use Policy, the Provider reserves the right to suspend or permanently block access.

(5) No financial or legal advice: The responses of the MEILENKÖNIG AI serve exclusively for general information and do not constitute financial, tax or legal advice. The Provider assumes no liability for the accuracy, completeness or timeliness of the AI-generated responses. Decisions, in particular regarding credit card applications or financial matters, must be made by the Customer on their own responsibility and after their own review.

(6) The Provider endeavors to ensure high availability of the service, but cannot guarantee uninterrupted availability. Maintenance work, technical faults or force majeure can lead to temporary outages. There is no claim to a reduction in fees for downtimes, provided that the service is available at least 95% on a monthly average.

§ 7 Right of withdrawal and cancellation

A) Digital products (Premium Handbook, AudioBook, Bundle)

The right of withdrawal expires in the case of a contract for the delivery of digital content not on a physical data carrier pursuant to § 356 (5) BGB if the entrepreneur has begun performance of the contract after the consumer has:

  • expressly consented that the entrepreneur begins performance of the contract before the end of the withdrawal period, and
  • confirmed their knowledge that they lose their right of withdrawal by giving their consent at the start of performance of the contract.

By purchasing the digital product, the Customer consents to immediate performance of the contract and confirms their knowledge of the expiry of the right of withdrawal.

B) AI Premium subscription (subscription)

For the AI Premium subscription as a distance contract, there is in principle a 14-day right of withdrawal from conclusion of the contract pursuant to § 355 BGB. Since the Customer, upon concluding the subscription, expressly consents that the service begins immediately and confirms their knowledge that they lose their right of withdrawal upon full performance of the contract, the following applies:

  • In the event of withdrawal within the 14-day period, the Customer must pay a proportionate amount for the period already used (§ 357a (2) BGB).
  • The proportionate amount is calculated on a daily basis based on the monthly price.
  • The withdrawal must be addressed in text form (e.g. email) to info@meilen-koenig.de.

Withdrawal instructions: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform us (CCX Consulting, David Lesnik, Gewerbegebiet Ost 15, 91085 Weisendorf, email: info@meilen-koenig.de) of your decision to withdraw from this contract by means of an unambiguous statement.

C) Coaching services

The following cancellation rules apply to coaching appointments:

  • Cancellation before the appointment is arranged: Full refund minus 99 EUR for the digital products already provided (Premium Handbook + AudioBook).
  • Rescheduling: Possible free of charge up to 24 hours before the agreed appointment.
  • Cancellation less than 24 hours before the appointment: No refund.
  • No-show: No refund.
  • After the coaching has been conducted: No refund.

The digital products included in the coaching price (Premium Handbook + AudioBook worth 99 EUR) remain with the Customer in any case and are excluded from the right of withdrawal.

§ 8 Rights of use

(1) Upon full payment, the Customer acquires a simple, non-transferable, temporally unlimited right of use for personal use.

(2) The transfer, reproduction, publication or commercial use of the digital content is not permitted without the express written consent of the Provider.

(3) Updates to purchased products are made available to the Customer free of charge by email.

§ 9 Liability

(1) The Provider is liable without limitation for intent and gross negligence.

(2) In the case of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations) and is limited to the foreseeable damage typical for the contract.

(3) The contents of the handbook do not constitute financial or legal advice. The Provider assumes no liability for economic decisions that the Customer makes on the basis of the contents.

§ 10 Affiliate notice

The product contains affiliate links to third-party providers. When using these links, the Provider may receive a commission. The recommendations are made to the best of our knowledge and belief on the basis of the Provider's expertise.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is the Provider's registered office.

(3) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.

(4) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
